York police investigating fake bomb threat seek public’s help

York police are asking the public’s help to find whoever is responsible for calling in a fake bomb threat Friday afternoon.

Police said dispatchers received a call at around 3:40 p.m. reporting a bomb threat at a home off Shelton Avenue. The call came from a woman who had said she had received the threat on her cellphone while she was out of the house.

Police, fire and ambulance crews responded and evacuated the residence and area houses. Nothing suspicious was found at the residence, police said.

“A thorough investigation of the incident and information obtained showed that the bomb threat was a hoax,” Sgt. John Lizanecz said in a statement.

Anyone with information is being asked to contact the York Police Department at 207-363-4444.

Anonymous tips made be made to the Seacoast Crime Stoppers by calling 603-431-1199, texting CRIMES (274637) and including TIPSCS in the message, or online by visiting the Seacoast Crime Stoppers website at www.seacoastcrimestoppers.com or its Facebook page.

Rewards of up to $1,000 may be paid for information that leads to the arrest or indictment of a suspect(s), police said.


‘Tiger Pride’ stolen from newly renovated athletic field in Biddeford

Police are investigating the theft of a sign at the newly renovated Waterhouse Field in Biddeford.

Thieves made off with orange letters spelling out “Tiger Pride,” but Superintendent Jeremy Ray says that pride remains as strong as ever.

“This will be something that will just make us stronger,” Ray said Friday night. “It will bring us together even more and our volunteers are even more determined to make sure we move forward.”

Ray said the theft occurred Thursday night. Volunteers had been at the field until 9:30 p.m. after putting some finishing touches on an 18-month renovation of the athletic facility.

The project included a new turf field, bleachers, a press box, lights and groundwork. Much of the project was done with funding, supplies and labor donated by the community.

The theft was discovered around 11 a.m. Friday, Ray said, valuing the loss at over $1,000.

“There is a lot of sweat equity in this field, for sure,” he said. “That’s what’s disappointing.”

Ray said the first field hockey game is scheduled to be held next Friday at the field, before the grand opening on Sept. 7. He said new lettering will be ordered and installed as soon as possible.

Biddeford Superintendent Jeremy Ray said said the theft of the “Tiger Pride” sign at Waterhouse Field “will be something that will just make us stronger.

New security cameras are scheduled to be installed Monday, he said.

Bil Moriarty , a former school board member whose daughter recently graduated from Biddeford High School, said he and other community members are upset by the theft, especially because the project was nearly finished.

“It’s frustrating. After months and months and months of watching these volunteers go in on the weekends and afternoons, on rainy days and 100-degree days – that’s insane,” Moriarty said. “That’s horrible for someone to go in and desecrate this beautiful stadium. But it’s not going to get us down. We’re going to keep going.”

Moriarty echoed Ray’s words about Tiger Pride. “Even if the words aren’t there, we all feel it and we all know it,” he said.

Biddeford police did not have any information to release Friday night, but Ray said they were “working diligently” to find the culprit or culprits.

“It’s disappointing that someone would do that, but with our group of volunteers we have here working on this field, they won’t be deterred by this,” Ray said. “It’s a sign that says ‘Tiger Pride.’ And Tiger Pride is really what these volunteers have been all about.”

Portland landlord begins serving jail sentence for conviction in fire that killed 6

The owner of the Noyes Street duplex where six people died in a 2014 fire has reported to jail to serve his three-month sentence for a misdemeanor safety code violation that contributed to the deaths.

Gregory Nisbet is believed to be the first landlord sent to jail for a safety code violation.

Gregory J. Nisbet, 52, reported to the Cumberland County Jail on Wednesday and is now housed in a unit alongside other sentenced inmates, said Corrections Capt. Steve Butts. Nisbet’s jail term is believed to be the first meted out to a landlord for a safety code violation.

Like most inmates not on special restrictions, Nisbet will spend all but roughly 15 hours a day locked in a cell. As long as he follows the rules, he will be eligible to reduce his jail time by one week per month, and can earn even more credit if he gets a job in jail.

“As long as he’s behaving himself and following the rules, the (classification) committee will review him and could approve him for inmate work,” Butts said.

Nisbet’s latest possible release date is Nov. 20, according to jail records.

His stint behind bars ends a three-year legal saga that began in 2015 with a nine-count grand jury indictment, including for six counts of manslaughter.

Nisbet waived a jury trial. His case was heard in 2016 before a Cumberland County judge. He was found not guilty of the manslaughter charges, but was found guilty of a single misdemeanor safety code violation for failing to provide a secondary means of escape on the upper floor of the two-family home, among other factors.

At the crux of the case were the building’s third-floor windows, which were too small to serve as a secondary means of escape. A contractor notified Nisbet of the non-compliant windows, but Nisbet did not replace them. He argued at trial that he provided the third-floor tenants with a rope ladder to escape, satisfying his duty under the safety code.

After his 2016 conviction, Nisbet remained free while he appealed the case, arguing in part that the building safety codes were designed for modern structures, and that the state’s fire code is unconstitutionally vague and inconsistently enforced.

Maine’s highest court disagreed, however, and on Aug. 2 issued an opinion upholding his conviction and sentence.

Killed in the blaze were Nicole “Nikki” Finlay, 26; David Bragdon Jr., 27; Ashley Thomas, 29; Maelisha Jackson, 23, of Topsham; Steven Summers, 29, of Rockland; and Christopher Conlee, 25, of Portland. Bragdon, Finlay and Thomas were tenants. Jackson, Summers and Conlee were visiting the house for a Halloween party.

The duplex at 20 Noyes St. caught fire in the early hours of Nov. 1, 2014, when the young people inside were sleeping.

Investigators said the blaze started on the front porch in a plastic receptacle for cigarette butts and spread to a couch and chair nearby. It tore quickly through the building, which lacked functioning smoke detectors. Flames blocked a stairwell that might have allowed the people inside to escape.

The fire prompted an intense review of building inspection procedures in Portland, and led to the creation of a new city division, the Housing Safety Office, focused on building safety and inspections. To fund the office’s work the city imposed a fee on landlords of $35 per unit beginning on Jan. 1, 2016.

Nisbet’s sentencing sent shock waves through the landlord community. Some criticized the policy of prosecuting building owners for conditions inside apartment units, arguing that landlords do not have direct control over every aspect of a building’s condition at all times.

Tenants frequently remove or disable fire alarms, or block mandatory pathways of escape with furniture or other belongings, they said.

Carleton Winslow, the vice president of the Maine Apartment Owners and Managers Group, said he thought the manslaughter charges were a stretch.

“I think it was a minimal sentence, given the circumstances, but I think there were other things that (Nisbet) ignored, as reported,” said Winslow, who said he was speaking only for himself. “I do think the whole thing served as a wakeup call to a lot of people.”

Most wanted New Hampshire fugitive arrested in Windham

The state of New Hampshire’s most wanted fugitive was arrested last week during a traffic stop on Route 302 in Windham.

Michael Mendoza, who was a passenger in the car that was stopped, along with another passenger, Brian Higgins, were arrested by a state trooper and members of the U.S. Marshals Violent Fugitive Task Force, according to a post on the Maine State Police Facebook page.

Mendoza – for whom no address or age were given – was described as “New Hampshire’s most wanted fugitive of the week.” The arrests were made on Wednesday.

Mendoza was taken into custody without incident.

Officers found narcotics on the floor of the motor vehicle and on Higgins, state police said. Because there was a 2-year-old child in the car at the time, both men were charged with aggravated trafficking. Each man was held on $50,000 bail at the Cumberland County Jail.

Warrants on Mendoza included failure to appear, aggravated eluding an officer, leaving the scene of a motor vehicle accident, aggravated driving to endanger, and a probation revocation for unlawful trafficking in schedule W drugs.

Officers found numerous bags used to package narcotics, a scale, 20 grams of fentanyl, 6 grams of cocaine, suboxone and prescription pills in the vehicle, according to state police.


To avoid ‘trauma of a trial,’ Acton woman pleads guilty to murdering ex-husband

ALFRED — An Acton woman accused of stabbing her former husband to death in February 2017 after learning he had been awarded custody of their two children pleaded guilty to murder Monday.

Kandee Collind, 48, formerly known as Kandee Weyland, entered a guilty plea to a charge of intentional and knowing murder at a hearing in York County Superior Court. The plea avoids a trial, which had been set to begin on Sept 17.

She initially pleaded not guilty during a court appearance in May 2017.

Collind faces a minimum of 25 years in prison. After the hearing, her attorney, Clifford Strike, said a plea agreement caps the sentence at 32 years. Collind is scheduled for sentencing on Nov. 19.

“She wanted to spare her children the trauma of a trial, which I think is honorable and the correct decision,” Strike said. “She is at peace with her decision.”

Collind told police that both children were in the car with her when she pulled into the driveway, crashed into a parked pickup truck and got into a confrontation with her ex-husband, Scott Weyland, according to a court affidavit filed by Maine State Police Detective Corey Pike. The children allegedly witnessed the stabbing.

The affidavit noted that one of the couple’s two children called 911 at 12:55 p.m. on Feb. 22, 2017, and said Collind had stabbed Weyland in the chest.

Nine minutes later, York County Sheriff’s Deputy Tom Searway arrived at 1097 Milton Mills Road in Acton, where Weyland had been living with his mother.

Searway allegedly found Collind administering CPR to her former husband outside on the ground. She was crying hysterically, and told Searway that she had stabbed him in the chest, and that he had pulled out a knife as well.

An autopsy revealed Weyland died of a stab wound to the chest, with penetration of the heart.

In court Monday, Collind, showing no emotion, quietly responded “yes” when Superior Court Justice Wayne R. Douglas asked if it was her intent to plead guilty to the charge.

Strike acknowledged that had the case gone to trial, the state could have proved its case against Collind.

The confrontation was sparked by a letter Collind received a few days after the couple’s divorce was finalized on Feb. 17, 2017, which awarded primary physical custody of their two children to her ex-husband.

According to police, Collind was taken into custody on the day her husband died and was taken to a hospital for evaluation. She was treated at Southern Maine Health Care in Biddeford for minor lacerations and, according to the affidavit, was found to be concealing a small knife stuck in her abdomen.

New York man arrested after Westbrook search finds drugs, stolen gun

A New York man was arrested on drug trafficking charges after Westbrook police say they found drugs and a stolen firearm in a Reed Street apartment on Saturday.

Westbrook police and the Maine Drug Enforcement Agency last week began investigating alleged drug trafficking at 27 Reed St. and obtained a search warrant for apartment 2, according to police.

During the search, Westbrook police found 89 grams of suspected cocaine, 36 grams of suspected crack cocaine, 26 grams of suspected Fentanyl, more than $9,000 in cash and a loaded 9 mm firearm that had been reported stolen in Virginia.

Police arrested 32-year-old Keon Grant of Brooklyn, New York, on a charge of aggravated trafficking in scheduled drugs, a Class A felony. He was taken to Cumberland County Jail.

Westbrook police say the investigation is ongoing and more charges are possible.

The Cumberland County Sheriff’s Department Emergency Services Unit helped serve the search warrant because of the possibility firearms were in the Reed Street apartment.

Police: Augusta man rejects neighbors’ food offer, threatens them with shotgun

AUGUSTA — Neighbors who offered an Augusta man a plate of food after he’d told them he hadn’t eaten much recently didn’t get the response they might have expected Sunday night.

Police say the man allegedly rejected a meal from the two neighbors before threatening to shoot them with a loaded shotgun.

BRUCE ROY

Bruce M. Roy, 48, was arrested Sunday night at his Eastern Avenue apartment, police said, after they arrived about found him standing on the porch, still armed with the shotgun.

In an affidavit filed at the Capital Judicial Center, Augusta police Officer Kyle Sheridan said he ordered Roy to drop the gun, and Roy complied.

Sheridan said Roy said he “was standing inside his apartment and could hear the neighbors in the apartment above him making statements about wanting to hurt and kill someone,” and he believed the neighbors were talking about him.

The man who is listed as a victim of threatening told police that an hour earlier he and Roy had smoked marijuana together, and that he and a woman who lived in a neighboring apartment brought Roy a plate of food for dinner because Roy said he hadn’t eaten much recently.

Roy returned it, apparently uneaten, and said to quit doing it.

Then, when the two neighbors were outside smoking a cigarette, Roy allegedly pointed a shotgun at them and threatened them, Sheridan said.

Sheridan said the seized shotgun has a shell inside the chamber and two more inside the firearm.

Roy was unable to post the $2,000 bail set by a bail commissioner and was taken to the Kennebec County jail that night. He was scheduled to make an initial court appearance Monday afternoon via video from the jail.

At court, Justice Donald Marden told Roy he was being charged with criminal threatening with a dangerous weapon, which carries a penalty of up to five years in prison and $5,000.

The prosecutor, Assistant District Attorney Kristin Murray-James, asked for $5,000 cash bail, citing “the severity of the situation here. Mr. Roy was holding a shotgun at his neighbors.”

Attorney Stephen Bourget, representing Roy as lawyer of the day, asked for a low cash bail or one that was unsecured but accompanied by a Maine Pretrial Services contract.

Marden set Roy’s bail at $1,000 cash with a Maine Pretrial Services contract and included conditions prohibiting Roy from possession of firearms and from use or possession of marijuana.

A condition of bail prohibits Roy from being at the apartments of the two victims.

Marden, after learning that the neighbors must pass by Roy’s door to get to their apartments, told Roy, “You’re not to have any contact with those people.”

The judge also asked the district attorney’s office to contact the neighbors about the bail condition.

“Tell them they are not to put him in a situation where he cannot avoid contact,” Marden said.

Two Biddeford men accused of assaulting black man face federal hate crime charges

Two white men from Biddeford have been indicted by a federal grand jury on hate crime charges for allegedly assaulting a black man outside a city convenience store while shouting a racial epithet.

Maurice Diggins, 34, and Dusty Leo, 27, are each charged with a hate crime and conspiracy to commit a hate crime, and are being held after making a first appearance in federal court Monday.

Both men’s attorneys say their clients deny the charges, and each will have bail hearings in the coming days.

The case triggered an outcry from activists who planned a rally after the assault in a show of solidarity against racism.

According to the indictment, Diggins and Leo were together in a pickup truck when they drove at high speed into the parking lot of 7-Eleven on April 15 and shouted at an African-American man who was walking toward the store entrance.

“Who you eyeballing, (racial slur)?” Diggins shouted, according to court records. Diggins then stopped the truck, got out and approached the man, repeating his question.

Diggins then circled the man, who is referred to as D.M. throughout the indictment. While Diggins was between the man and the store entrance with his back to the truck, Leo got out of the vehicle and struck the man on the head.

The victim then staggered backward, and when Diggins approached, the victim fell to the ground. As he got to his feet and began running away, Leo followed him on foot.

“The defendants shouted words to the effect of ‘Go on, run, (racial slur),” prosecutors allege in the indictment.

Diggins and Leo then got back into the truck and drove after the victim, again shouting the racial epithet, it says.

The man’s jaw was broken during the encounter and he hit his head on the pavement when he fell to the ground. He escaped by running down a side alley.

Leo’s attorney, Amy Fairfield, said her client vehemently and adamantly denies the charges.

“(Leo) was not involved in any hate crimes, and we’ll let the criminal justice system properly run its course,” Fairfield said.

Randall Bates, the attorney for Diggins, said his client will fight the charges going forward.

“(Diggins) adamantly denies any wrongdoing and is looking forward to being exonerated after his trial,” Bates said in an email message.

Each man faces up to 10 years in prison for the hate crime charge and five years in prison on the conspiracy, and $250,000 in fines for each count, according to federal court records unsealed Monday.

Each was initially charged in state court with two counts of aggravated assault and one count of interfering with someone’s constitutional rights, and also faced a civil rights complaint filed by the Maine Attorney General’s Office. Neither of the men appeared for the civil case and a judge issued a permanent injunction ordering both of them to not have any further contact with the victim or face up to 364 days in jail and up to a $2,000 fine.

The aggravated assault charges are Class B felonies punishable by up to 10 years in state prison and a $20,000 fine, and remain pending in York County Superior Court.

Leo has a criminal record including convictions for carrying a concealed weapon, trafficking in dangerous knives and two OUIs, according to the State Bureau of Identification.

Diggins has an extensive criminal history that began in 2003 and includes multiple convictions for theft and burglary, and has been in and out of state prison, according to the State Bureau of Identification.

Antique automobile stolen from home in Nobleboro

The Lincoln County Sheriff’s Office is investigating the theft of an antique automobile from a home in Nobleboro.

The theft is believed to have occurred between May and Aug. 15, the day that the owner discovered it was missing, Lt. Brendan W. Kane said in a statement.

The auto is described as a 1930 Ford Model A Coupe. It is green with black fenders. According to police, the 88-year-old antique car has current Maine passenger registration plates.

Readfield man gets 8 years for violating probation from ice chopper attack

AUBURN — A Readfield man was sentenced Monday to eight years in prison for violating his probation stemming from an ice-chopper assault on a Lewiston man in 2007.

Luke Blair, 28, was sentenced in Androscoggin County Superior Court on Monday by Justice Thomas E. Delahanty II.

Two days before he turned 18, Blair was part of a group of teens who robbed Gary St. Hilaire in an alley near Bartlett and Walnut streets in November 2007. An ice chopper was found with St. Hilaire’s blood on the blade, its wooden handle splintered from the force of the blow. St. Hilaire suffered a nine-inch skull fracture, language, memory and right-side body impairments, a prosecutor said previously.

Blair was initially bound over for trial as an adult on a charge of attempted murder. The charge was dismissed in an agreement to plead guilty to elevated aggravated assault that capped his prison sentence at 12 years. He served nearly 10 years before being released on probation in 2017.

He was then charged with domestic violence assault and domestic violence criminal threatening against his then-girlfriend in Dec. 28, 2017, in Readfield.

On Jan. 5, Lewiston police, who had been searching for Blair, captured him after he took off on foot on Ash Street, barricaded himself in an apartment and attempted to jump out a window.

Blair admitted to violating his probation on charges of aggravated criminal trespass, criminal mischief, refusing to submit to arrest and assault on an officer stemming from that incident. He was sentenced to an additional three years in prison and four years probation.

On Aug. 6, Delahanty found Blair committed domestic violence assault and domestic violence criminal threatening against his then-girlfriend in 2017, confirming that he violated his probation sentence from the 2007 attack.

He was sentenced to serve eight more years of that sentence.

Oakland man admits sexual assault on 5-year-old

AUGUSTA — An Oakland man pleaded guilty Tuesday to sexually assaulting a 5-year-old girl who was being baby-sat by his wife.

Ronald M. Mullen, 57, was ordered to serve an initial four months behind bars, with the remainder of the five-year sentence suspended while he spends four years on probation.

Mullen had been ordered to undergo a mental evaluation after his initial court appearance when he was so distraught he kept running his fingers through his hair.

On Tuesday at the Capital Judicial Center, Mullen answered the judge’s questions in a low voice.

“He’s very nervous, your honor, ” said his defense attorney, Brad Grant.

Mullen pleaded guilty to a charge of unlawful sexual contact that occurred Nov. 22, 2017 in Oakland. The charge carries a penalty of up to 10 years in prison.

The girl’s mother spoke at the hearing, telling Mullen that he did “a horrible, selfish thing.”

“My usually bright and cheery child turned into an insecure one,” she said. ” For days afterward, she asked me, ‘Am I still beautiful?'”

The woman said Mullen’s actions have torn apart her family.

“You have made it almost impossible to trust anyone at all,” she told Mullen.

The woman said her daughter says she will forgive Mullen, but the mother says she will not.

“You harmed an innocent child who told you several times to stop and you didn’t,” she said. “You turned our whole lives upside down; you make my worst nightmares come true.”

As she spoke, Mullen who was seated next to his attorney, cried and used a tissue to wipe his eyes.

Mullen spoke briefly in court, saying, “I’m very sorry, truly sorry.”

Justice Thomas E. Delahanty II imposed the sentence that was recommended by both the prosecution and the defense, saying it spared the young girl the ordeal of having to testify at trial and that it reflected the defendant’s lack of prior criminal convictions.

The prosecutor, Assistant District Attorney Michael Madigan, described the evidence the state would have presented if Mullen had gone to trial. Madigan said the girl told her mother that Mullen had “touched her privates” several times.

Madigan said the mother saw no sign of injury.

He also said Mullen initially denied to police that anything had occurred, but later said he touched the girl over her clothing and it only occurred once.

“First he said it was an accident, and later said it was more than playing,” Madigan said. “He would deny that the contact was skin-to-skin.”

Conditions of probation require Mullen to undergo sex offender evaluation and counseling, and prohibit him from contact with children under 16. The conviction classifies Mullen a lifetime registrant under the state’s Sex Offender Registration and Notification Act.

Grant told the judge that Mullen tried to take responsibility for his actions as soon as possible in the case.

The victim’s mother sobbed as she left the courtroom accompanied by the victim/witness advocate from the district attorney’s office.

Maine man confesses, gets 15 years for 1979 death of infant son, but the case isn’t over

The photograph in Venus Nappi’s hand was faded by nearly four decades of passed time, but the smile on the baby’s face was still clear.

“We keep talking about my son,” Nappi said. “I’d just like you all to know who my son was.”

The woman stood at the podium Tuesday in Cumberland County Unified Criminal Court, mere feet from her ex-husband, Burton Hagar, who had just pleaded guilty to manslaughter in the death of their infant son, Nathan Hagar, in 1979. Her voice was thick with emotion, but her hand was steady as she held the picture up for the few people gathered in the courtroom to see.

“I’m really glad that he gets some justice for all the things that were done to him,” Nappi said of her son. “And I guess I just want you to know how nice he was.”

Hagar, 63, will now begin a 15-year prison sentence. But his unusual case is not over, despite the plea agreement and Hagar’s repeated confessions. His lawyer, Verne Paradie, plans to file an appeal to the Maine Supreme Judicial Court, challenging a judge’s ruling that the baby’s death 39 years ago was a homicide and not a case of Sudden Infant Death Syndrome. The guilty plea was conditional, meaning Hagar can withdraw it if the state’s highest court determines a crime wasn’t committed and dismisses the case.

“I’m hoping that the Law Court will adopt the federal standard for corpus delicti, which is basically that you can’t convict someone on an unreliable confession,” Paradie said. “Mr. Hagar’s confessions have been so inconsistent and unreliable that I hope the Law Court sees that, because there is no physical evidence linking him to this at all.”

Nathan Hagar was 4 months old when he died in his crib in a Brunswick apartment on May 9, 1979. His death was initially attributed to SIDS, but his father later confessed to more than a dozen people that he smothered the infant with a pillow. Maine State Police videotaped his admissions in 1991 and last year.

He was not charged until April 2017, however, after he confessed twice more to state police. In Maine, as in most other states, a confession alone is not enough for a conviction. The state needs to also prove that a crime has taken place, which is known as corpus delicti.

This year, a Brunswick police officer testified to Superior Court Justice Thomas Warren that he found a pillow stained with mucus on one side in Nathan Hagar’s crib when he responded to the call about an unresponsive baby. The pillow was not part of his initial report about the incident. A retired state medical examiner also reviewed records in the case and told the judge she would clasify the infant’s cause of death as asphyxiation, not SIDS. In April, Warren ruled that Nathan Hagar’s death was the result of a crime, which allowed the homicide case to move forward.

That decision triggered the plea agreement presented Tuesday. Paradie said it would likely take more than a year for the state Supreme Court to make a final decision on the case.

Turner man indicted in massive drug bust in Lewiston/Auburn

PORTLAND — A Turner man faces several federal charges connected to a massive drug bust in February.

Andrew Waite, 29, of Turner was indicted in U.S. District Court on charges of illegal possession of a firearm in relation to a drug trafficking crime, illegal possession of an unregistered silencer and possession with intent to distribute marijuana.

In February, local, state and federal law enforcement agents searched more than 20 sites in Androscoggin County — including Waite’s Nezinscott Drive home. As part of the search of Waite’s residence, agents seized about 100 pounds of marijuana, firearms, a Ferrari and more than $150,000 in cash, according to a statement from the U.S. Attorney’s Office.

Waite was arrested July 18 in North Carolina and was scheduled to make a court appearance this afternoon in U.S. District Court in Portland.

If convicted, he faces between five years and life and a $250,000 fine on the firearm charge, up to five years and a $250,000 fine on the drug charge, and up to 10 years and a $250,000 fine on the silencer charge.

Two Auburn men have already been arrested and charged following a sweeping federal drug raid in and around the Twin Cities on Feb. 17.

Brian Bilodeau, 33, and Tyler Poland, 32, were indicted last month by a grand jury. Jury selection in each defendant’s trial is expected to begin Sept. 4.

Bilodeau is facing two felony counts: possession with intent to distribute marijuana and possession of a firearm in furtherance of a drug trafficking crime.

The first charge is punishable by up to 20 years in prison and a $1 million fine. On the second charge, Bilodeau faces five years to life in prison and a fine of up to $250,000.

Poland was indicted on two counts: possession with intent to distribute MDMA, commonly known as ecstasy, and possession with intent to distribute marijuana. The maximum punishment for each of the felonies is 20 years in prison and a fine of up to $1 million.

Both men pleaded not guilty at arraignment to all counts and are free on bail. Both men were ordered to surrender their passports.

The charges stem from a Feb. 27 federal raid by drug agents, who said a drug trafficking organization was distributing large quantities of marijuana under the cover of Maine’s medical marijuana program. Officials alleged that the organization sold to buyers who were not legal participants in the state-sanctioned program and included out-of-state customers.

Federal, state and local law enforcement agents had executed more than 20 search warrants in the Lewiston-Auburn area.

Agents searched Bilodeau’s home, where they seized a reported 183 pounds of marijuana, butane hash oil, a loaded .380-caliber pistol, a loaded 9mm pistol, an unloaded .45-caliber pistol and an unloaded .22-caliber rifle.

The marijuana, hash oil and one gun were found in a concrete room measuring 8 feet by 10 feet in the basement of Bilodeau’s home. The room was secured with a metal vault door, according to an affidavit filed by a federal drug agent. Two guns were found in the master bedroom, one on top of a nightstand and loaded. The rifle was found in another bedroom.

Agents also seized a 2016 Lamborghini Huracan, valued at $190,000, and a 2014 Nissan GT-R, valued at $60,000. Automobiles can be forfeited as proceeds from drug trafficking, assisted in drug trafficking or were involved in money laundering offenses.

In his indictment, Bilodeau faces forfeiture to the federal government of any money used in the commission of crimes with which he is charged, and any guns used in crimes, including his Beretta BU9 Nano 9mm pistol found in his home.

On Feb. 27, federal agents searched the house, warehouse and office of Poland, who was arrested March 12.

The search of Poland’s office turned up files for his company, TY Construction, which is incorporated in Maine, according to agents.

In the office, agents discovered pink ecstasy pills in a small credenza between two bookshelves, according to an agent’s affidavit filed with the court.

Agents also found two bags concealed behind another desk in the office. One bag contained pink pills, the other white pills believed to be alprazolam, a generic prescription tranquilizer. No prescription bottle for the medication was found at the office, Gagnon wrote.

Tax records reflected income earned by TY Construction, the agent wrote.

Agents found a key in a baseball glove that opened an office safe where $140,000 in cash had been secured. Another $16,370 in cash was found elsewhere in the office.

Poland faces forfeiture of all property seized by agents that is believed to have been received in connection with the drug charges again him.

The property includes: $156,370 in cash seized from his office Feb. 27, a Tag Heuer Carrera Calibre 1887 wristwatch, $72,293.39 in three TD Bank accounts and $220,000 in a Mechanic Savings Bank account.
