Rice from stolen Chinese takeout leads to arrests in Lewiston

LEWISTON — Rice found in the tread of a suspect’s shoes helped lead to arrests in the mugging of a Chinese food delivery man.

Three males were arrested and charged with robbery and theft in the April 9 mugging.

An Androscoggin County grand jury indicted two men on related charges. The third is a juvenile. He was released to the custody of his mother.

In a police affidavit, Detective Joey Brown wrote that a delivery driver went to 169 Bartlett St. at 8:46 p.m. to deliver $72 worth of takeout food from Chopsticks restaurant of Lewiston. The driver called the telephone number he had been given and was told to meet the customer in the hallway.

The driver climbed the stairs to the second-floor landing, where he was met by a male wearing a black Columbia jacket and black pants. According to the affidavit, the driver told the customer how much was owed for the food. The customer then said he did not have the money.

The driver “did not feel right and began walking down the stairs to leave the building,” Brown wrote.

The same male, this time joined by two men, confronted the driver in the building’s first-floor hallway. Someone punched the driver in the head before he was kicked by a second person, who wore red shoes, he later told police.

The driver dropped the food to the floor and fell back against the stairs while the three males picked up the food and fled the building through a back door, Brown wrote.

In city surveillance video of Pierce and Birch streets, police could see three males who appeared to be carrying Chinese food takeout containers running down the street shortly after 8:46 p.m. One of the males appeared to have red sneakers, Brown wrote.

Police went to an apartment at 96 Birch St., where they found Melvin Blake, 23, who was the renter, and a 16-year-old juvenile. Officers saw a pair of red sneakers “with what appeared to be Chinese rice stuck to the bottom of them,” Brown wrote.

Officers also saw a black Columbia jacket draped over the back of the couch.

One of the officers observed Chinese food takeout containers on top of the garbage can, Brown wrote.

Blake told police he had been wearing the red shoes, but had gone grocery shopping at Walmart, bought some marijuana and returned home that night. After he was shown a clip from the surveillance video, he denied knowing anything about the mugging, Brown wrote.

Blake and Kulcharan Singh, 19, also of 96 Birch St., were charged with robbery, punishable by up to 30 years in prison, and theft by unauthorized taking, a misdemeanor.

Blake said he had a gun. Police later charged him with possession of a firearm by a prohibited person, a misdemeanor.

The juvenile was charged with robbery and theft. He told police he was told to go for a walk with the two men, according to police. The men instructed him to meet with the driver and tell him he had no money. He said Blake and Singh jumped the driver and knocked the food from his arms, then fled with it.

The juvenile denied assaulting the driver. He said he had worn a black Columbia jacket.

Bail for Blake was set at $5,000 cash or supervised release and $10,000 for Singh. Both men are scheduled to be arraigned Friday.


Wilton man sentenced to 2½ years for strangling woman

FARMINGTON — A Wilton man accused of choking a woman until she passed out during a sexual encounter in February was sentenced Thursday to serve 30 months of an eight-year sentence.

Steven E. Pare, 50, pleaded guilty to a felony charge of aggravated assault and misdemeanor charges of domestic violence assault and unlawful sexual touching at Franklin County Superior Court.

Pare’s Alford plea was based on his belief that he is not guilty but thinks that if the state’s evidence were presented to a jury he could be found guilty.

Pare faced up to 10 years in prison on the aggravated assault charge.

A felony charge of gross sexual assault and a misdemeanor charge of violating a condition of release were dismissed in the negotiated plea agreement.

He was indicted in April.

If the matter went to trial, the victim would have testified that she came to Maine and stayed with the defendant in Wilton. The two had previously been domestic partners and occasionally still saw each other.

She would have testified that Pare choked her until she passed out during what started out as consensual sex but turned nonconsensual. Pare did not stop when she repeatedly indicated she wanted him to stop, Deputy District Attorney James Andrews said.

Testimony would have also been heard that there was bruising on the victim’s neck and signs of strangulation on her hairline. The victim also had an abrasion on her knee. The injuries were documented.

The sentence could be criticized as too lenient, Justice Robert Mullen told Pare, but it was Mullen’s understanding that the victim did not want to go to trial and “you are taking responsibility.”

After Pare serves his Department of Corrections sentence, he will serve two years of probation.

Mullen sentenced Pare to 364 days each for the sexual touching and domestic violence assault charges that will be served at the same time as the aggravated assault sentence.

Pare has been held on $10,000 cash bail at the Franklin County Jail since Feb. 27.

Associate of bookie admits role in gambling operation

A Portland man connected to what police are calling Maine’s largest illegal gambling operation has pleaded guilty to federal charges.

William Flynn, 76, pleaded guilty Thursday in U.S. District Court to running an illegal gambling business. He faces five years in prison, according to a news release from the office of U.S. Attorney Halsey B. Frank.

According to court records, between 2010 and April 7, 2017, Flynn participated in Stephen Mardigan’s illegal sports gambling business operating in Portland. Mardigan, who pleaded guilty last month to running an illegal gambling operation and money laundering, received bets on professional and college sporting events for 14 years. According to the release, Flynn coordinated bets with Mardigan, shared profits and losses with him, and communicated regularly with him about sports lines, bets taken and other aspects of the business. Mardigan also served as the “bank” for Flynn’s bets.

Flynn has agreed to forfeit nearly $75,000, and will be sentenced after a presentence investigation by the U.S. Probation Office.

Mardigan is still awaiting sentencing. He could face 28 years in prison and will have to forfeit hundreds of thousands of dollars in cash seized by federal agents last year, give up real estate worth at least $5.6 million and pay restitution of $1.3 million under the outline of a plea deal.

The case was investigated by a network of local, state and federal law enforcement agencies, including the FBI; Portland, South Portland, Lewiston, Westbrook, Bangor and Cape Elizabeth police; the Maine State Police; the Internal Revenue Service and the U.S. Postal Inspection Service.

Michael Liberty, other defendants deny allegations they defrauded investors

Former Portland developer Michael Liberty and other defendants are formally denying allegations that they defrauded investors of nearly $50 million.

The federal Securities and Exchange Commission charged Liberty and the others – including his wife, lawyer and cousin – in April, alleging they tricked investors into putting money into a technology startup and instead used the funds to pay for chartered flights, expensive homes and cars, production of a movie and the purchase of a dairy farm in Maine.

The charges relate to Mozido, a Texas-based company that Liberty founded and which was supposed to develop applications that would allow users to access banking and other financial services via their cellphones.

Papers filed Friday in U.S. District Court in Portland deny the SEC allegations paragraph by paragraph, but don’t offer any specific rebuttals of the charges.

According to the SEC charges, Liberty sold investors shares in shell companies that allegedly could be converted into stock in Mozido. But, according to the SEC’s lawsuit, the shell companies either didn’t have convertible shares or were barred from transferring the investments. Liberty and the others, the suit charges, lied to the investors about Mozido’s valuation, finances, Liberty’s investments and how their funds were to be used.

Named in the suit in addition to Liberty, 57, are his wife, Brittany Liberty, who was Liberty’s bookkeeper before the couple married; Portland lawyer George Marcus; Rick Liberty, a cousin of Michael Liberty; Paul Hess, a friend of Rick Liberty; and five shell companies.

Rick Liberty and Hess found investors, the allegations say, and kept Brittany Liberty (nee Abbass) informed of their progress. Marcus provided legal advice on handling the investments, the SEC alleges, and drafted documents that misrepresented or omitted facts about the investments.

Michael Liberty, his wife and Hess pocketed most of the money that came in, the SEC said. For instance, according to the suit, of the first $19.2 million from investors, $16 million was transferred to Xanadu Partners, a company controlled by Liberty, and was used to pay personal bills and court fines; settle lawsuits; underwrite a movie that Brittany Liberty was producing; and pay for interior decorating services.

Liberty and Marcus denied the allegations publicly shortly after the charges were filed. On Friday, all of the defendants filed formal denials of the charges in U.S. District Court in Portland.

The filings by the defendants also ask that a judge issue judgments in their favor and order the SEC to pay their legal fees.

A Philadelphia law firm said it is investigating the allegations and is recruiting investors who lost money to join together to try to recover some of their investments. That could possibly lead to a lawsuit against Liberty and the others.

The SEC suit is the latest in a string of legal problems for Liberty, a Gray native who developed Portland’s 100 Middle Street office complex and Chandler’s Wharf condominiums in the 1980s before moving on. He now lives in Florida, although he still has holdings in Maine and the SEC contends most of the activity in the allegations occurred here.

Last summer, Liberty pleaded guilty in federal court in Portland to violating campaign finance laws, served four months in a federal prison and paid a $100,000 fine.

The SEC is also asking a federal judge in Pennsylvania to reinstate $5.4 million of a fine against Liberty for allegedly defrauding investors there. Liberty filed financial statements showing that he had a net worth of negative $29 million while bragging that his Mozido holdings were worth $127 million.

The judge had cut Liberty’s fine to $600,000 based on the documents. The SEC said that Liberty lied about his finances and it is asking that the original $6 million fine be reinstated.

Two Maine men charged with illegal drug trafficking

Maine State Police arrested two Maine men late Thursday on the Maine Turnpike and charged them with drug trafficking and possession of a firearm by a felon.

State police reported on Instagram that Trooper John Darcy of Troop G and the Pro-Active Criminal Enforcement Team stopped a vehicle about 11:30 p.m. Thursday on the turnpike in York. During a search of the vehicle, 103 grams of crystal methamphetamine, a small amount of liquid meth and a loaded 9 mm rifle with a high-capacity magazine were found.

Both occupants are felons who are prohibited from possessing firearms, state police said.

Driver Justin Cohen, 26, of Portland was charged with aggravated trafficking of illegal drugs, possession of a firearm by a prohibited person, and violation of conditions of release. He was also booked on six active warrants and will be charged with operating after revocation and failure to give correct name and date of birth to a law enforcement officer, state police said.

Passenger Dan Doody, 36, of Durham was charged with aggravated trafficking of illegal drugs, possession of a firearm by a prohibited person and violation of conditions of release.

Both are being held at the York County Jail in Alfred.

Suspect spills fentanyl inside cruiser at Cumberland County Jail

A Cumberland County sheriff’s deputy had to be medically evaluated after a man under arrest spilled fentanyl inside a cruiser early Sunday morning.

Capt. Wayne Pike said in a statement that Tannis A. Goodson, 29, of Raymond had been arrested on a variety of charges and had just arrived at the Cumberland County Jail’s sally port when the deputy realized that Goodson had spilled the drug on the back of the cruiser seat and on the floor of the cruiser.

“The cruiser was locked down and secured and Goodson was transported to Maine Medical Center to be screened for an exposure,” Pike said. “The deputy was also evaluated and cleared and no corrections officers were exposed.”

Pike said the jail intake area had to be shut down until the cruiser and intake area could be decontaminated. The incident took place around 4:30 a.m.

Goodson was charged with operating without a license, operating while under the influence of drugs, violating conditions of release and possession of a scheduled drug.

Fentanyl is a powerful synthetic painkiller. According to the Office of National Drug Control Policy, first responders need to protect themselves from possible exposure. Fentanyl can be inhaled if the powder becomes airborne and can be dangerous if it comes into contact with skin.

Slow breathing, drowsiness and constricted or pinpoint pupils are signs consistent with fentanyl intoxication. Naloxone can be used to reverse the effects of fentanyl.

Armed man robs store in Penobscot County

Penobscot County authorities are investigating an armed robbery that took place Sunday afternoon at a Milford store.

Chief Deputy William R. Birch of the Penobscot County Sheriff’s Office in a statement that a man entered the County Road Store, 81 County Road, Milford around 2 p.m., flashed a handgun at the store clerk, and demanded cash.

None of the clerks at the store were injured, but the robber fled on foot with an undetermined amount of cash, running in the direction of the Henderson Lane subdivision.

Anyone who saw a man coming from behind the store and walking through the subdivision wearing sweatpants is asked to call the Sheriff’s Office at 945-4636. Maine State Police and Old Town police are assisting the sheriff’s office.

Portland police officer who was arrested in Massachusetts resigns

The Portland Police Department’s first Somali police officer resigned Sunday before the department could complete an internal affairs investigation prompted by her arrest at a Massachusetts nightclub in January.

Portland police officer Zahra Munye Abu was arrested by Worcester, Massachusetts, police on charges of assault and battery, resisting arrest, trespassing, disorderly conduct and disturbing the peace at a January concert.

Zahra M. Abu, 25, of Portland had been on paid administrative leave since she was charged by Worcester police with assault and battery, resisting arrest, trespassing, disorderly conduct and disturbing the peace on Jan. 13.

The charges stem from alleged conduct inside the Palladium, a music venue where Abu was attending a concert by Ja Rule and Ashanti.

Abu pleaded not guilty to the charges. She has remained free on personal recognizance and was ordered to stay away from the Palladium.

Meanwhile, Portland police said they were conducting an internal review of the incident. In announcing the resignation, city officials declined to offer any details of what the internal review found.

“Zahra Abu voluntarily resigned from the Portland Police Department on June 10 prior to the completion of the police department’s Internal Affairs investigation,” wrote Jessica Grondin, spokeswoman for the city. “As this is a confidential personnel matter, no additional information can or will be released.”

A message left for Abu with a relative was not returned. Portland Police Chief Michael Sauschuck also did not respond to questions about Abu’s resignation.

In a report filed in court, Worcester police said the 5-foot-2, 130-pound officer was acting aggressively toward concert hall staff and pushed her way through the crowd, “physically assaulting several customers.” Told by security and police that her behavior was unacceptable and she was “no longer welcome on the property,” Abu was asked to leave “two to three dozen times,” according to the report.

Worcester police Officer Christopher Grilli wrote that after being told she was under arrest, Abu “tensed her body and tried to pull away from us in an effort to evade arrest. She squirmed around and tried to free herself from the handcuffs.”

The report alleges that Abu swore at police, questioned their training and time in service and “refused to cease her profanity-laced comments toward staff.”

Outside, as officers waited for a patrol wagon to take Abu to police headquarters, she moved toward another patron and said, “They’re racial profiling, I see you there, girl,” according to court documents.

Abu gained widespread media and community attention two years ago when she became the first member of Maine’s Somali community to be sworn in as a police officer.

Abu was born in Kenya, where her Somali-born parents were living in a refugee camp, and moved to Maine when she was 2 years old.

She attended college and studied criminal justice and women-and-gender issues at the University of Southern Maine before joining the Portland Police Department in 2016.

Despite Abu’s resignation, she could still face discipline from the Maine Criminal Justice Academy board of trustees, the group that confers the license required to be a police officer in Maine.

Under state statute, there are a host of circumstances that require a police officer’s employing agency to report conduct to the board for review and possible sanctions, including convictions on a bevy of crimes.

The board also reviews cases in which there is no conviction but an officer is found to have engaged in conduct that would be criminal, such as when an internal investigation by a department results in a finding of fact but there is no corresponding criminal case.

Academy executive director John Rogers said he received the internal affairs investigation regarding Abu from the Portland police chief on Monday, and will forward it to a subcommittee of three trustee members who will conduct a preliminary review of the case and eventually make a recommendation regarding disciplinary action to the full board.

The subcommittee of trustees has the option to wait until Abu’s criminal proceedings in Massachusetts are complete, or they may find the internal affairs report complete and credible enough to proceed on its merits alone, Rogers said.

Police say Portland High student brought pellet gun to school after making threat

Portland police arrested a 15-year-old Portland High School student after they found a realistic-looking pellet handgun in his backpack last week.

The male student was charged with one count of Class D terrorizing, police said in a statement Monday.

Administrators learned about 7:45 a.m. on Thursday that he had threatened sometime earlier to bring a gun to school.

By 8 a.m., the school resource officer located the student in a class and searched his backpack. Lt. Robert Martin, spokesman for the Portland Police Department, said the resource officer found a pellet gun that resembled a “realistic handgun” in the backpack.

Police said no specific threats were made to the school, other students or staff. The student was released into the custody of his parents.

The case is now in the hands of the Cumberland County District Attorney’s Office, which will review it before deciding whether to move forward with charges. Separately, the Portland School Department will determine whether other discipline is warranted.

Portland Superintendent Xavier Botana said in an email Monday night that the school department will follow through with appropriate discipline based on school policies “with all appropriate due process.” He did not elaborate on what the discipline might involve.

“There was not a threat issued at any time,” Botana said. “Administrators learned about the possibility of the student having a weapon from a report they were given on Thursday morning. The investigation is ongoing, but I do not believe that the weapon was ever displayed.”

Botana said the high school did not go into lockdown, adding that “the appropriate response for this specific situation” did not call for one.

Parents were notified Friday morning via school messenger, Botana said.

The identities of juveniles charged with misdemeanor crimes are confidential.

Bangor man gets 10 years in federal prison for child porn

A Bangor man has been sentenced to 10 years in federal prison for possessing child pornography.

David Jack, 44, was also sentenced Monday by U.S. District Judge John A. Woodcock Jr. to 15 years of supervised release. The sentencing took place in federal court in Bangor.

According to authorities, in the summer of 2016, Jack used a cellphone to show images of children engaged in sexual activity to a 9-year-old girl. Bangor police then got a search warrant for Jack’s home and seized two laptops and a cellphone. They found more than 2,000 children engaged in sexually explicit conduct on the devices.

Jack pleaded guilty to the charge in January.

New Hampshire man gets prison time for making false tax claim

A New Hampshire man was sentenced on Monday to serve one year and one day in prison and pay more than $100,0000 in restitution for making a false claim for a federal tax refund.

Robert E. DeAngelis, 38, of Portsmouth was sentenced in federal court in Portland by U.S. District Judge Jon D. Levy, according to the U.S. Attorney’s Office.

In addition to prison time, DeAngelis must pay $100,574 in restitution to the Internal Revenue Service. He pleaded guilty on Jan. 16, 2018.

According to court records, DeAngelis – who was living in North Berwick when the false tax claims were filed – falsely reported his income, as well as the amount of federal income tax that was being withheld from him, on his 2014 joint income tax return.

As a result, the IRS issued a refund payment of $31,615, an amount he was not entitled to receive, the U.S. Attorney’s Office said.

The restitution order also reflected improper refund payments that DeAngelis received in connection with the filing of his 2011, 2012, and 2014 tax returns.

The case was investigated by the IRS Criminal Investigations division.

Maine State Prison inmate dies in hospital

An inmate at the Maine State Prison in Warren died Monday, the Maine Department of Corrections said.

In a statement, Corrections Commissioner Joseph Fitzpatrick identified the inmate as Darrell Crosby, 59.

Fitzpatrick said Crosby was serving a split sentence of six years for unlawful sexual contact, with all but 18 months suspended, and eight years of probation. He began serving his sentence on Aug. 18, 2017.

Crosby died about 12:20 p.m. at Pen Bay Medical Center in Rockport, according to Fitzpatrick. He did not provide any details about the circumstances of Crosby’s death, but the Department of Corrections notified Maine State Police and the Medical Examiner’s Office.

Crosby, who lived in Jefferson before he was sent to prison, was sentenced in Knox County Superior Court. Around the time of his sentencing, Crosby was receiving cancer treatment, according to a story published in June 2016 by the Bangor Daily News.
