Waterville sex offender indicted on new gross sexual assault charge

AUGUSTA — A Waterville man already classified as a lifetime sexual offender has been indicted on a new charge of gross sexual assault in connection with a woman in Benton.

David Louis Woodard, 55, pleaded not guilty to the charge on Friday when he was arraigned at the Capital Judicial Center via video from the jail next door.

Judge Tom Nale told Woodard that the class A charge carries a maximum penalty of 30 years in prison.

Assistant District Attorney David Spencer requested bail be set at $5,000 cash, but Nale set it at $25,000, citing Woodard’s criminal history and the seriousness of the offense charged.

Attorney Stephen Bourget, representing Woodard as attorney of the day, told the judge, “Mr. Woodard is not able to make $5,000 bail or anything else.”

Woodward has two previous convictions for unlawful sexual contact, one in 2000 in Bangor Superior Court, and the other in 1988 in Newport District Court.

The indictment, handed up April 19 by a grand jury in Kennebec County, was unsealed only after Woodard’s arrest Thursday morning.

The indictment says Woodward “did engage in a sexual act with (a woman) who submitted as a result of compulsion” on Dec. 5, 2016, in Benton.

A second charge appearing on the indictment was dismissed. No other details were available in the court file.

New York City police to lead funeral procession of Cpl. Eugene Cole to Bangor

In the aftermath of the killing of Cpl. Eugene Cole and the successful apprehension of the man suspected of killing him, Somerset County Sheriff Dale Lancaster pointed out that “a lot of officers will say that they’re fine. I want to tell you that they’ve been all deeply affected — not only our agency, but all agencies have been deeply affected by what has happened, me included.

“Cpl. Cole died on my watch, and it’s something that I will carry with me for the rest of my life and I will never forget.”

In an interview Thursday at his office in East Madison, Lancaster said, “From throughout the country, we’ve been contacted. Different agencies are going to be sending representatives. We’re anticipating that it’s going to be a large event.”

Lancaster would not estimate the anticipated number of people who will attend visiting hours Sunday at the Skowhegan Armory or the service Monday at the Cross Center in Bangor, but he said there have been inquiries from as far away as California.

“Since Tuesday we’ve had teams preparing and mapping and planning how we’re going to approach the Cross Center and how, logistically, we’re going to deploy,” Lancaster said. “We’ve been told the Cross Center holds up to 14,000 people. This is not only for law enforcement, but it affects the communities in Somerset County and it affects everyone in the state of Maine.”

An elite motorcycle unit from the New York City Police Department will lead a funeral procession through Skowhegan on Monday morning, en route to the memorial services in Bangor for Cole, who was shot and killed April 25 in the line of duty.

Cole was 61 and a 13-year veteran of the sheriff’s office. He was the first Maine police officer to die in a shooting in nearly 30 years. Lancaster said Maine State Police Detective Gil Landry was the last Maine law enforcement officer to be murdered in the line of duty, on March 31, 1989. Lewiston police Officer David R. Payne was murdered on July 23, 1988, he said.

John D. Williams, 29, of Madison, is alleged to have shot and killed Cole and stolen his marked cruiser just after 1 a.m. April 25. He made his first court appearance Monday in Augusta and was charged with intentional or knowing murder. Williams is being held without bail at the Maine Correctional Center in Windham.

Visiting hours for Cole will be 4 to 7 p.m. Sunday at the Skowhegan Armory, 11 North School St., Skowhegan.

North Avenue in Skowhegan will be closed 3 to 8 p.m. Sunday from the intersection of East Street through the intersection of East Dyer Street. Residents of that area will be able to get to and from their homes.

Law enforcement will be parking at the Skowhegan Fairgrounds. Civilian parking will be available at Margaret Chase Smith School on Heselton Street. The path from the school to the armory has been cleared for people to use getting to the armory. The Kennebec Valley Community Action Program will be assisting with handicapped-accessibility.

“We’re calling it a walk-by,” Lancaster said of the Sunday service. “Gene is going to be at the armory for people in the community and law enforcement that want to pay their respects from 4 to 7 p.m. If it goes past 7 o’clock, we’re not closing the door. We will continue to allow people to pay their respects until everyone’s had a chance to do that.”

Somerset County Detective David Cole, Eugene Cole’s son, who was with the sheriff during Thursday’s interview, said the casket will be closed at the Sunday event. He said the family mourns.

“She’s holding up well,” he said of his mother, Sheryl Cole. “The very strong community support has been great and support from the sheriff’s office and the law enforcement community has been great.”

Speaking for himself, losing his father, a fellow law enforcement officer, David Cole said he is “doing well.”

David Cole held the rank of corporal — like his father — until Wednesday, when he was tagged to fill an open detective’s position at the sheriff’s office. Lancaster said the timing was coincidental.

There will be a parking ban from 7 to 11 a.m. Monday on Madison Avenue and Water Street in Skowhegan. Madison Avenue and Water Street will be closed to traffic 10 to 10:30 a.m. as the procession taking Cole from Smart & Edwards Funeral Home in Skowhegan to the memorial service in Bangor moves through town to U.S. Route 2, according to Skowhegan Road Commissioner Greg Dore.

A celebration of Cole’s life will be held at noon Monday at the Cross Insurance Center, at 515 Main St., Bangor, with Chaplain Kevin Brooks officiating.

“The procession will come back through town — Water Street, Commercial Street and Madison Avenue — at approximately 4 p.m. to return Cpl. Cole to the funeral home,” Dore said. “Expect traffic delays.”

Lancaster said the funeral procession, led by the NYPD motorcycle unit, will be followed by a hearse with Cole’s body, then by the immediate members of Cole’s family, followed by the “family” of Somerset County officials and a Maine State Police cruiser — about 40 cars in all.

A state police honor guard will participate in services Sunday and Monday. Lancaster said the Bangor Chamber of Commerce has helped with placing visitors from out of the area in local hotels.

Somerset County Administrator Dawn DiBlasi said she expects Monday’s celebration of Cole’s life to be an emotional one.

“On Monday, May 7, the county will say their final goodbyes to Cpl. Eugene Cole,” DiBlasi said in a statement. “He was loved by all and he will be missed by his coworkers and the citizens of Somerset County. It is clear to us that Cpl. Cole knew the meaning of community policing and was more than just a deputy in our community.

“While we cannot make sense of this tragedy, we can honor Cpl. Cole’s memory by following his example. We are told that even the people he arrested felt he was a fair, evenhanded deputy who gave respect and consideration to everyone he came in contact with. Thank you Cpl. Cole for your service to Somerset County. You will never be forgotten.”

A spokeswoman at the Cross Center referred all questions on venue preparation to Steve McCausland at the Maine Department of Public Safety.

McCausland said Friday that there will be designated areas for the news media.

Doors will open to the public at 8 a.m. Monday at the Cross Center and seating for the public will be on a first-come, first-served basis, McCausland said. There will be security checkpoints, large handbags are discouraged and no weapons will be allowed. The Cross Center’s website has specifics.

Bangor Police public information officer Wade Betters has issued a traffic advisory for Monday around the Cross Center. The best advice for motorists not attending the services is to find alternate routes away from the area, McCausland said in an email. Hundreds of police cars will be arriving for the services, and traffic and parking will be a challenge, he said.

Jail closed to new inmates for 2 hours because of fentanyl contamination

The Cumberland County Jail was unable to take in prisoners for about two hours Friday, while part of the jail was decontaminated of the drug fentanyl.

The drug was released into the air at the jail’s intake area while Brent Gross, 29, of Westbrook, was being processed following his arrest on charges of possession and trafficking of fentanyl.

While Gross was being searched, he refused to give up the drugs he had with him and refused to comply with staff. While Gross was being restrained and removed from the intake room, some of the drug fell to the ground and some of the powder went airborne, according to a news release from the Cumberland County Sheriff’s Office.

The powder was tested and found to be fentanyl. Intake officers were sent to Maine Medical Center for possible fentanyl exposure, treated, and later returned to work. The intake facility was closed between about 4 p.m. and 6 p.m. while officers cleaned and decontaminated the area. The rest of the jail was placed in temporary lockdown during that time.

Two men wounded with same knife during fight in Old Orchard Beach

Old Orchard Beach police are investigating a fight between two men who were apparently wounded with the same knife.

Police responding to a reported stabbing at the Family Dollar Store on Heath Street at 1:16 p.m. Saturday discovered a 23-year-old Lewiston man with a severe cut on a leg. But a second man – identified only as a 60-year-old resident of Milton, Massachusetts – was also found with cuts on his body.

According to a statement from the Old Orchard Beach Police Department, the initial investigation suggests the men began fighting while they were inside the Family Dollar Store. Police were unsure what sparked the altercation but believe the same knife was used to inflict the wounds on both men.

The men, whose names had not been released as of Saturday evening, were taken to different hospitals for treatment. Both were reported to be in stable condition.

No charges have been filed but the investigation continues.

 

Arundel man charged with domestic assault

An Arundel man is being held without bail at the York County Jail in Alfred on a charge of domestic assault against his girlfriend.

York County Sheriff William King said in a statement that Robert Jordan, 33, of Portland Road, was arrested for punching and choking his girlfriend by deputies who were called to the 2600 block of Portland Road for a disturbance about 1 a.m. Sunday.

Jordan will be arraigned Monday by video.

Police said Jordan was not eligible for bail because of the charge.

Man who shot woman in Portland’s Bayside neighborhood still at large

A 49-year-old woman who was shot Sunday outside an apartment building in Portland’s Bayside neighborhood is expected to recover, but the man who shot her remained at large Sunday night. A neighbor said the woman was shot in the knee.

Portland police spokesman Lt. Robert Martin said the woman and her attacker were arguing on a sidewalk in the vicinity of 19 Parris St. when he shot her at 8:44 a.m. The victim’s name is not being released.

In a statement, Martin described the assailant as a “younger white male” who was armed with a silver semi-automatic handgun. He was driving a silver sport utility vehicle with a Massachusetts license plate starting with the numbers 771.

Martin said there was a white male passenger in the front seat of the SUV. After he shot the woman, the man was last seen driving toward Portland Street.

The Bayside neighborhood has a cluster of social service agencies, such as the Preble Street Resource Center and the Oxford Streeet Shelter, which attract large numbers of homeless and drug-addicted people on a daily basis.

In this past weekend’s edition, the Maine Sunday Telegram provided a graphic and disturbing look at the area. It’s not uncommon for residents to see drug use, fights and even sexual acts in public places, and the activities have pushed some of them to the edge of their tolerance.

“It used to feel like it was a coexistence, but now I feel violated,” Sarah Michniewicz, who has lived on Cedar Street near the city shelter for 20 years, told the newspaper. “I can’t walk into my backyard without wondering what I will find.”

Police were not saying what provoked the argument and violence Sunday morning. In an email Sunday evening, Martin said he would not be able to comment further because of the ongoing investigation by police detectives.

But Laura Cannon, a Parris Street resident, said the shooting may have been drug-related. The shooting happened on a sidewalk near her home.

Cannon said she and her husband went outside to investigate and overheard the victim, whom she did not recognize, telling police that she had confronted her assailant about doing drugs on a public way. Cannon said the woman told officers that the man and his friend were smoking crack cocaine.

“The guy said (expletive) and shot her in the knee,” said Cannon, who is vice president of the Bayside Neighborhood Association.

“She had been shot in the knee and was sitting on the sidewalk and bleeding,” said Cannon, who has lived in the neighborhood since 2010.

Cannon said that in the past, she herself has confronted people doing drugs on the street, but plans to be more cautious in the future considering what happened Sunday.

Parris Street was shut down for several hours by police investigating the shooting. Motorists who had parked on the street were not allowed to move their vehicles while police investigated.

The Smyrna man shot by a Maine State Police sergeant during an armed confrontation at the Thriftway convenience store in Oakfield on Friday has died.

Maine Department of Public Safety spokesman Steve McCausland said John Corneil, 54, died Saturday at Eastern Maine Medical Center in Bangor.

An autopsy was being conducted Sunday at the state Medical Examiner’s Office in Augusta, McCausland said in a press release.

Three troopers went to the store on Ridge Road in Oakfield, an Aroostook County town west of Houlton, to try to arrest Corneil on warrants for assault, criminal threatening, terrorizing and reckless conduct in an incident earlier in the week in Smryna.

As customers watched, Corneil threatened the troopers with what appeared to be a handgun. Sgt. Chad Fuller, a 20-year veteran of the state police, shot Corneil. Corneil was using what was later determined to be a pellet gun that looked like a semi-automatic pistol, McCausland said.

The Maine Attorney General’s Office continues to investigate the incident, which is standard in all police-involved shootings, he said.

Authorities release mugshot of Westbrook man they say caused drug scare at jail

Authorities on Sunday released the mugshot of the Westbrook man they say caused a drug scare at the Cumberland County Jail Friday.

The photo of 29-year-old Brent Gross shows him with a cut on his forehead, a shaved head, and droopy eyelids. He appears to be wearing some type of protective vest.

The Cumberland County Sheriff’s Office, which operates the jail, said in a statement that Gross was being searched by intake officers around 4 p.m. Friday when he refused to surrender drugs that he had in his possession. At the time, he was being processed after being arrested by Westbrook police on charges of possession and trafficking of fentanyl.

Gross had to be removed from the processing area and restrained, the statement said, but the scuffle caused some of the drugs he had with him to fall onto the floor. The contents of one container went airborne, forcing intake officers to be treated for fentanyl exposure at Maine Medical Center.

The jail intake workers were treated and able to return to work. The substance that went airborne was tested and found positive for fentanyl.

The jail intake area had to be closed for about two hours and the rest of the facility went into lockdown following the incident.

Gross made bail over the weekend, according to jail workers.

Portland police still waiting to talk to Bayside shooting victim

Portland police had no new information Monday about a shooting in Bayside a day earlier, but they hoped to speak to the victim, a 49-year-old woman who was still being treated at the hospital.

Lt. Robert Martin said police did not plan to release the woman’s name at least until detectives have a chance to interview her.

“Right now, we just want to hear from her,” Martin said.

The shooting occurred just before 9 a.m. Sunday on Parris Street, not far from one of the city’s main social service agencies, Preble Street Resource Center.

Police said the victim and the assailant had been arguing just before shots were fired.

The suspect was described as a young, white male. He drove off in a small silver SUV, possibly with Massachusetts plates, with a passenger, also a white male. They fled the area in the vehicle and the shooting suspect is considered at large.

Martin said he couldn’t release any information about a possible motive and couldn’t say whether the victim and gunman knew each other.

“We’ve talked to some witnesses but have been hearing different things,” he said.

Police do not believe there is an imminent threat to anyone else.

The victim was taken to Maine Medical Center with what police described as non-life threatening injuries. A neighbor said Sunday that the woman was shot in the knee.

Laura Cannon, who lives on Parris Street and is vice president of the neighborhood association, said the shooting may have been drug-related. Cannon said she and her husband went outside to investigate and overheard the victim, whom she did not recognize, telling police that she had confronted her assailant about doing drugs on a public way.

In the past, Cannon said she, too, has confronted people doing drugs on the street but plans to be more cautious in the future after what happened Sunday.

Martin said detectives tried to interview the victim Monday morning but she was still heavily medicated. They planned to try again later in the day.

At the crime scene late Monday morning, there was fresh orange paint with letters marking spots but no neighbors were home near where the shooting took place.

Two city employees who were operating a mobile needle exchange a couple of blocks from the shooting scene said there hadn’t been much talk about what had happened.

Portland’s Bayside neighborhood has a cluster of social service agencies, such as Preble Street and the Oxford Street Shelter, which attract large numbers of homeless people and drug users on a daily basis.

In this past weekend’s edition, the Maine Sunday Telegram provided a graphic and disturbing look at the area, where it’s not uncommon for residents to see drug use, fights and even sexual acts in public places.

Gorham police seek public’s help in identifying burglars

Gorham police are seeking the public’s help in identifying two men who were caught on surveillance video breaking into a local business last month.

Detective Steven Rappold did not identify the business, saying only that it is in Gorham Village.

The men broke into a rear entrance to the business around 2 a.m. on April 24, Rappold said in a statement. They stole an undisclosed amount of cash from the register at the front of the business before fleeing through the rear entrance.

One of the burglars is described as a white man with a large build. He is 30 to 40 years old, was wearing a half-zip pullover, a baseball cap, jeans and sneakers. He had partial facial hair and was wearing black-rimmed eyeglasses.

The other burglar is described as a short black man with a thin build. He was wearing a hooded sweatshirt with the hood pulled over his head and face. He appeared to be wearing jeans and sneakers.

Welfare fraud suspect to be released on bond

Two men charged with welfare fraud appeared in federal court Monday in Portland seeking release from jail.

U.S. District Magistrate Judge John Rich III ordered Abdirashid Ahmed, 38, of Lewiston released on $5,000 bond after seizing his passport.

Rich said Ahmed would be equipped with an electronic monitoring device to ensure he does not leave Androscoggin County.

Ahmed was being held Monday night in federal custody at the Cumberland County Jail. He was expected to be escorted Tuesday to Lewiston and released into the custody of the U.S. Probation Office. He must get permission from that office if he were to seek to leave Androscoggin County in the future, Rich said.

Garat Osman, 32, of Auburn appeared in the same courtroom after Ahmed.

Dylan Boyd, who represented Osman on Monday, agreed to continue Osman’s detention hearing to Thursday, giving him time to hire a lawyer. It also gave the court time to consider Osman’s financial declaration form that he signed earlier under the penalty of perjury.

Rich said he was concerned about inconsistencies between that document and Osman’s tax returns from last year.

More than two dozen men and women from the Somali community sat in the gallery to show their support for the men.

Ahmed and Osman, who have been indicted by a federal grand jury, were arrested last week and charged with health care fraud involving MaineCare – Maine’s Medicaid program – and receiving health care kickbacks for more than two years.

Both men are accused of referring MaineCare beneficiaries to an unnamed health care provider and served as Somali interpreters, according to investigators.

The indictment also said that from May 2015 to December 2017, Ahmed and Osman conspired to defraud MaineCare by billing the program for interpreting services not rendered or partially rendered.

Fraudulent bills allegedly were submitted to MaineCare that overstated the health and interpreter services provided.

Maine man kills himself after chase, Massachusetts police say

NEW BEDFORD, Mass. – Police say a driver from Maine shot and killed himself on a Massachusetts highway after leading officers on a chase and threatening to shoot anyone who tried to stop him.

Massachusetts State Police say the man was driving erratically Saturday night and was reported to be suicidal and armed. A trooper tried to stop the vehicle in Freetown and gave chase when the man would not pull over.

Video from a police helicopter shows the vehicle later stopping on Route 140, where police say the driver shot himself. He was taken to a hospital in New Bedford and pronounced dead.

Delaware man sentenced to three years on drug charges

A Delaware man was sentenced Monday to three years in prison for dealing heroin and crack cocaine in Maine.

Kyle Rivers, 26, of Bear, Delaware, was also sentenced by U.S. District Court by Judge John A. Woodcock, Jr. to three years of supervised release.

Rivers had pleaded guilty to the charge in Portland on Nov. 28.

According to authorities, Rivers’ hotel room in Brunswick was raided on Aug. 1, 2017, and heroin, crack cocaine, Xanax pills and about $10,500 in drug proceeds were seized.

At the time, Rivers was on probation in Maryland following a drug trafficking conviction there.
